The High Court in Kuala Lumpur today allowed National Feedlot Corporation's chairperson Mohamad Salleh Ismail's application for Public Bank Bhd to disclose documents it used in its domestic inquiry following the disclosure of accounts of NFC and Salleh's personal accounts.

Judge John Louis O'Hara in his decision in chambers allowed the application today after hearing it yesterday in open court.

Justice O'Hara issued his ruling under Order 24 Rule 12 of the Rules of Court 2012.

NFC, along with National Meat Livestock Corporation Sdn Bhd, Agroscience Industries Sdn Bhd and Real Food Company Sdn Bhd and Salleh, had applied for all documents and transcripts that the bank held in a domestic inquiry on its former employee, Johari Mohamad.

Salleh had sought the documents as it claimed it was relevant in the civil suit filed against the bank and the bank is in possession of the confidential documents.

Johari and Pandan MP Rafizi Ramli are now facing separate charges under the Banking and Financial Institutions Act 1989 (Bafia) for the offence.

Rafizi, 39, claimed trial to disclosing Public Bank's customer profile documents comprising balance summaries relating to the NFC, National Meat and Livestock, Agroscience Industries and Salleh to media consultant Yusuf Abdul Alim and to The Star reporter Erle Martin Carvalho at the PKR headquarters in Petaling Jaya on March 7, 2012.

Johari, 44, was charged with conspiring with Rafizi to commit the offence at the same place and date.

Salleh and the others are claiming RM60 million in general damages, RM250 million in exemplary damages and another RM250 million in aggravated damages.

Salleh was represented by lawyers M David Morais, Syed Ismat Syed Muhamad, Al Firdaus Shahrul Naing and Sara Ann Chay Sue May.

The case is now fixed for case management on June 9, before Justice O'Hara.
